As you’ve seen and as we shared last week, NAR recently announced a new MLS policy, Multiple Listing Options for Sellers, that aligns with its Clear Cooperation Policy (CCP). This policy creates a new listing category called Delayed Marketing Exempt Listings, which allows brokers to delay the public marketing of a listing through IDX and syndication for a period of time as determined by the local MLS. Sellers must agree to this option in writing. A Delayed Marketing Exempt Listing still must be entered into the MLS but does not preclude the listing firm from marketing the listing in a manner consistent with their seller’s choice.

IRES leadership is currently evaluating how to implement this policy and determining what the delayed marketing period will be. We’ll let subscribers know as soon as we have a plan in place. In the interim, with written seller permission, you can mark a listing as “Publish to
Internet=NO” upon listing entry to remove it from IDX feeds. In most cases, this will also disable the listing from appearing on your own brokerage website. To restore the IDX feed, simply edit the listing to “Publish to Internet=YES” at the end of the delayed marketing period for your seller.
Clear Cooperation Policy Remains in Place
Please remember that CCP remains in place and brokers must continue to submit each new listing to the MLS within one business day of marketing a property to the public.
